Terms and conditions for using Piano Fitness application and website

Introduction

Welcome to Piano Fitness. By accessing or using our mobile application (“App”) and website (“Website”), you agree to be bound by these Terms of Use. Please read them carefully. If you do not agree to all of these terms, you may not use our services.

Piano Fitness is developed as an open source project under the Apache License 2.0. The application is designed to help piano students develop their technical skills through interactive exercises and practice tools.

Open Source License

The Piano Fitness application code is available as open source software under the Apache License 2.0. This means:

  • You are free to use, modify, and distribute the software for any purpose
  • You may create and distribute derivative works based on the software
  • Any modifications or derivative works must retain appropriate copyright notices and disclaimers
  • The full text of the Apache License 2.0 is available at: https://www.apache.org/licenses/LICENSE-2.0

While the application code is open source, the Piano Fitness name, logo, and brand assets remain the property of Piano Fitness and are not included in the Apache License 2.0 grant.

Acceptable Use

When using Piano Fitness, you agree to:

  • Use the App and Website in compliance with all applicable laws and regulations
  • Respect the intellectual property rights related to the content and services
  • Not engage in any activity that could harm, disable, or impair the functioning of the App or Website
  • Not attempt to gain unauthorized access to any systems or networks connected to the services
  • Not use the services for any unlawful or prohibited purpose

User-Generated Content

If you contribute to the Piano Fitness open source project (e.g., through GitHub), you agree that:

  • You have the necessary rights to the content you contribute
  • Your contributions may be used, modified, and distributed under the terms of the Apache License 2.0
  • You grant Piano Fitness a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, publish, and distribute your contributions as part of the Piano Fitness project

MIDI and Music Rights

Piano Fitness is designed to work with MIDI input devices for educational purposes. We do not:

  • Provide copyrighted musical compositions or sheet music
  • Grant rights to reproduce, perform, or distribute copyrighted musical works
  • Claim ownership of any musical compositions you may create or practice while using the App

Users are responsible for ensuring they have appropriate rights for any musical content they use in conjunction with Piano Fitness.

Disclaimer of Warranties

THE PIANO FITNESS APP AND WEBSITE ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Warranties regarding the security, reliability, timeliness, and performance of the services
  • Warranties regarding the accuracy or completeness of any information or content provided

Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Piano Fitness AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, data, use, or other intangible losses
  • Cost of procurement of substitute products or services
  • Any other damages arising out of or related to your use or inability to use the App or Website

This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if we have been advised of the possibility of such damage.

Changes to Terms

We reserve the right to modify these Terms of Use at any time. We will provide notice of any significant changes by posting the new Terms on the Website and updating the “Last Updated” date. Your continued use of the App or Website after such changes constitutes your acceptance of the new Terms.

Governing Law

These Terms of Use are governed by and construed in accordance with the laws of Finland, without regard to its conflict of law principles. Any legal action arising out of these Terms shall be brought exclusively in the courts of Finland.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect, and the invalid or unenforceable provision will be deemed modified so that it is valid and enforceable to the maximum extent permitted by law.

Entire Agreement

These Terms of Use, together with our Privacy Policy, constitute the entire agreement between you and Piano Fitness regarding your use of Piano Fitness.
